These Terms of Service (the "Terms") are an agreement between you and AlphaSource Technologies Inc., operating as MindMechanix ("MindMechanix", "we", "us"). They govern your use of mindmechanix.app, the MindMechanix member app, our sessions, journal, Hub, texts and emails, and the book Thirty Second Mind Mechanix (together, the "Service"). By creating an account, making a purchase, or using the Service, you agree to these Terms. If you don't agree, please don't use the Service.

1. What MindMechanix is, and isn't

MindMechanix is peak-performance coaching built on Neuro-Linguistic Programming, delivered by an AI coach we call the Mechanic, with guidance and content from a Master Practitioner of NLP. It is education and coaching for personal and professional performance.

MindMechanix is not therapy, counseling, medical care, psychological treatment, hypnotherapy, financial advice or legal advice, and it does not diagnose, treat or cure any condition. Nothing in the Service is a substitute for care from a licensed professional. If you are in crisis or thinking about harming yourself or others, stop using the Service and contact emergency services or a crisis line (in the US, call or text 988). Please also read our Legal Disclaimer.

2. Who can use it

You must be at least 18 years old and able to enter a binding contract. You are responsible for your account, for the accuracy of what you tell us, and for keeping your email access, passphrase and recovery words safe.

3. Plans, prices and billing

• Free ($0): a daily General Excellence session, your Blueprint and a text onboarding session, the guided journal, the Hub and the Vault.
• Core Identity ($49/month) and Apex Identity ($179/month): what each includes is described on our site at the time you buy. Prices are in US dollars and exclude any taxes we are required to collect.
• The book: a one-time purchase for the download or the paperback.

Memberships bill monthly in advance through Stripe and renew automatically until you cancel. You can cancel at any time from your Hub; cancellation takes effect at the end of the current billing period and you keep access until then. When a membership ends, your account moves to the Free plan and your data stays. We may change prices with at least 30 days' notice; a change applies from your next renewal after the notice.

Daily allowances apply to each plan (how many new sessions can be built in a day) so that the Service stays reliable for everyone. Replaying sessions you've already built is unlimited.

4. Refunds

Membership payments are non-refundable except where the law requires otherwise, or where we decide, at our discretion, that a refund is fair (for example a duplicate charge). Downloads are non-refundable once delivered. Paperbacks follow the return policy stated with the order. If something went wrong with a charge, write to us; we'd rather fix it than argue.

5. Your Vault, your keys

Your private journal and life-goal diary are encrypted on your device with your passphrase. We never have your passphrase or recovery words, and we cannot reset them. If you lose access to your email, your passphrase and your recovery words, your Vault is permanently lost. You accept that this is how the Vault works, and that we cannot recover it for you.

6. Your content

You own what you write and the sessions built for you. You give us the limited permission we need to store, encrypt, process and deliver your content to you, including sending your coaching material (never your Vault, unless you choose) to our AI and voice providers to build your sessions. When you share an excerpt, anyone with the link can read it until it expires or you revoke it. You are responsible for what you share and with whom.

You agree not to use the Service for anything unlawful, to harass anyone, to attempt to break or probe its security, to scrape or resell it, to impersonate another person, or to try to make the Mechanic produce content that is harmful, defamatory or infringing.

7. Our content

The MindMechanix name, logo, the Mechanic, the sessions, scripts, voice recordings, the book, and the site are owned by AlphaSource Technologies Inc. or its licensors and protected by copyright and trademark law. Your membership gives you a personal, non-transferable licence to use them for your own development. You may not copy, record, redistribute, resell or publicly perform sessions or recordings, or use the Mechanic's voice elsewhere.

8. Messages

By opting in, you agree to receive coaching texts and emails as described in our Privacy Policy. Reply STOP to end texts; use the stop link to end coaching emails. Consent is not a condition of purchase.

9. Inactive accounts

Paying members are never archived or erased. Free accounts that go quiet are moved to long-term storage and, after a longer period, erased, as set out in the Privacy Policy. We will always email you before each step, and signing in brings everything back.

10. Changes to the Service

We're building something that improves over time, so features, allowances, AI and voice providers, and content will change. We'll give reasonable notice of changes that reduce what you've paid for, and you can cancel if you don't like them.

11. Ending your account

You can erase your account at any time from your Vault settings; this is immediate and permanent. We may suspend or end accounts that break these Terms, abuse the Service or create legal risk, and we'll tell you why unless the law prevents it.

12. Disclaimers

The Service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don't promise any particular result: your results depend on the work you put in. AI-generated content can be wrong; use your own judgment.

13. Limitation of liability

To the fullest extent the law allows, AlphaSource Technologies Inc. and its officers, employees and providers will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from the Service. Our total liability for any claim is limited to the amount you paid us in the twelve months before the claim. Some jurisdictions don't allow these limits, so they may not fully apply to you.

14. Indemnity

You agree to defend and hold us harmless from claims arising from your content, your use of the Service, or your breach of these Terms.

15. Disputes

These Terms are governed by the laws of the State of Washington, USA, without regard to conflict-of-law rules. Before filing any claim, you agree to write to us at contact@mindmechanix.app and give us 30 days to resolve it informally. Any dispute that isn't resolved will be brought in the state or federal courts located in King County, Washington, and you consent to their jurisdiction. Each of us agrees to bring claims only individually, not as a class or representative action.

16. General

These Terms, with the Privacy Policy, Cookies Policy and Legal Disclaimer, are the whole agreement between us about the Service. If any part is unenforceable, the rest stands. We may update these Terms; we'll post the new version with a new date and tell you in your Hub before material changes take effect. Continued use after that is acceptance.
